Terms of Service

1. Who we are

The BehaviouralSafety.org platform is operated by Hi Vis Safety Ltd (company 16385867, registered in England and Wales), trading as Behavioural Safety. References to “we”, “us” or “the Platform” mean Hi Vis Safety Ltd.

2. Who these terms apply to

• Consultants — H&S professionals who hold accounts on the platform and use it to deliver services to their clients.
• Client portal users — staff at consultants' client organisations invited by a consultant.
• Survey respondents — employees who complete an anonymous survey deployed by a consultant. See the respondent privacy notice.
• Visitors — anyone browsing the marketing site without an account.

Consultants who use the paid Business Hub features also accept the platform agreement at /c/terms when they first sign in.

3. Account creation and authority

When you create a consultant account, you confirm that you (a) are at least 18 years old, (b) are authorised to enter into this agreement on behalf of any organisation you represent, and (c) will keep your login credentials secure. You are responsible for activity carried out under your account.

4. Acceptable use

You may not use the platform to:

• Send spam, harvested email, or unsolicited bulk communications.
• Upload data you do not have lawful authority to process.
• Attempt to identify individual survey respondents or circumvent the anonymity safeguards.
• Reverse-engineer, copy, white-label or resell the platform without a written agreement.
• Use the platform in any way that breaches UK GDPR, the Equality Act, the Data Protection Act 2018, or other applicable law.

5. Pricing & billing

Current pricing is shown on /for-consultants and /crm. Subscription fees are billed yearly or quarterly in advance via Stripe. Per-survey and per-audit fees are charged at the time of purchase. We may change prices on notice; any change applies at the next renewal — never mid-period for an active subscription.

6. Refunds & cancellation

See our refund policy. In short: subscription fees are refundable within 14 days of first purchase, per-survey/per-audit fees are non-refundable once the survey has been deployed (because the AI processing has already happened), and recurring renewals can be cancelled any time before the next billing date.

7. Data & privacy

We process personal data as described in the Privacy Policy. Where the platform processes survey data on a consultant's behalf, the consultant is the controller for their client's engagement; we are the processor. The standard Data Processing Agreement applies. Sub-processors are listed at /privacy/sub-processors.

8. Intellectual property

The platform, the BSD framework, the audit-action catalogue, and all UI / source code are owned by Hi Vis Safety Ltd. Consultants own the data they upload and the reports they generate. We retain the right to use anonymised, aggregated data for benchmarking — see the privacy policy for the detail.

9. Service availability

We aim for high availability but the platform is provided “as is”. Planned maintenance is communicated in advance. We are not liable for missed deadlines that arise from circumstances beyond our control (DNS issues, AWS outages, third-party API downtime).

10. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under English law. Subject to that, our total liability under or in connection with these terms is limited to the fees you have paid us in the 12 months preceding the event giving rise to the claim.

11. Termination

You can close your account any time via Settings → Deactivate Account. We may suspend or terminate accounts that breach these terms, with notice where reasonable. After deactivation we retain personal data for 30 days then permanently delete it, except where law requires retention (e.g. financial records held for 7 years per HMRC).

12. Governing law

These terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the English courts.

13. Changes to these terms

We may update these terms. Where changes are material we will give registered users at least 30 days' notice via the platform or email. Continued use after the effective date constitutes acceptance.
